Terms Of Service

These Terms of Service ("Terms") govern your access to and use of www.theologyofthesoul.org (the "Website") operated by Theology Of the Soul LLC ("we," "us," or "our"). By accessing or using the Website, placing an order, or creating an account, you agree to be bound by these Terms. If you do not agree, do not use the Website.
1. Use of the Website
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Website. You agree to use the Website only for lawful purposes and in accordance with these Terms.
2. Accounts
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately of any unauthorized use.
3. Products and Services
We offer products, services, and digital downloads. Descriptions and pricing are subject to change without notice. We reserve the right to refuse or cancel orders.
4. Payments
All payments are processed securely through Stripe, our third-party payment processor. By providing payment information, you authorize us (via Stripe) to charge the applicable amount, including taxes and fees. You represent that you are authorized to use the payment method provided.
- Prices are in USD and exclude shipping/taxes unless stated.
- You are responsible for all charges.
- For subscriptions (if applicable): Billing occurs monthly until canceled.
- Refunds: Refunds are at our discretion and there are no refunds on digital products or virtual services. See our Refund Policy and contact us regarding refund requests at customersupport@theologyofthesoul.org.
5. Shipping and Delivery (if applicable)
Processing Times:
Orders are typically processed within 5 to 7 business days after payment is confirmed and cleared (excluding weekends and holidays). Processing time does not include shipping time. We make every effort to ship orders as quickly as possible, but delays may occur due to high order volume, inventory issues, or unforeseen circumstances. You will receive an email confirmation when your order ships, including tracking information where available.
Shipping Methods and Carriers:
We ship using reliable carriers such as USPS, UPS, FedEx. Available shipping options (e.g., Standard, Priority, Express) and associated costs are displayed at checkout and depend on order size, weight, destination, and selected method.
Shipping Costs:
Shipping rates are calculated at checkout based on the shipping address, package weight, dimensions, and selected shipping method. We offer free shipping on orders over $200. All shipping charges are non-refundable unless otherwise stated in our Refund Policy.
Estimated Delivery Timelines:
Delivery estimates are provided at checkout and are approximate only. They do not include processing time. Typical transit times (after shipment) are:
- Domestic (U.S.) Standard Shipping: 3–7 business days
- Domestic Priority/Express: 1–3 business days
- International: 7–21 business days or more, depending on customs and destination
These are estimates only. We are not responsible for delays caused by the carrier, weather, holidays, customs clearance (for international orders), incorrect shipping addresses, or other factors beyond our control.
Shipping Restrictions:
We currently ship within the United States (including Alaska and Hawaii), Canada, and Mexico — We do not ship to PO Boxes, APO/FPO addresses, or certain restricted countries due to carrier limitations. If your address is in a restricted area, we will notify you and may cancel the order or offer alternatives.
Risk of Loss, Title, and Ownership:
Title to the goods and risk of loss or damage pass to you upon our delivery of the items to the carrier for shipment (a "shipment contract" under applicable law). This means:
- Once the package leaves our facility and is accepted by the carrier, you assume responsibility for the goods.
- We are not liable for loss, theft, damage, or delay occurring during transit.
- Inspect your package immediately upon receipt.
- If the package appears damaged, note it with the carrier at delivery (if possible) and take photos.
- Contact us within 7–14 days of receipt at customersupport@theologyofthesoul.org with photos of the damage, packaging, and any relevant details.
- We may require return of the damaged item (at our expense in some cases) before issuing a replacement or refund, subject to our Refund Policy.
International Shipping and Customs:
For international orders, you are responsible for all import duties, taxes, brokerage fees, and customs clearance charges. These are not included in the purchase price or shipping cost and are payable upon delivery. We have no control over customs delays or fees, and we are not liable for packages seized or held by customs authorities.
Address Changes and Failed Deliveries:
It is your responsibility to provide a correct and complete shipping address. If a package is returned to us due to an incorrect, incomplete, or undeliverable address (including refusal of delivery), you will be responsible for reshipping costs or we may cancel the order and issue a refund minus original shipping fees and return charges.
Force Majeure:
We are not liable for failure or delay in shipping due to events beyond our reasonable control, including but not limited to natural disasters, strikes, pandemics, government actions, carrier disruptions, or supply chain issues.
Changes to Shipping Policy:
We may update this shipping information from time to time. Continued use of our services after changes constitutes acceptance.
6. Intellectual Property
All content on the Website (text, graphics, logos, etc.) is our property or licensed to us. You may not reproduce, distribute, or create derivative works without permission.
7. User Content
If you submit content (reviews, comments), you grant us a non-exclusive, royalty-free license to use it. You represent that your content does not infringe third-party rights.
8. Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages arising from your use of the Website or products. Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim.
9. Indemnification
You agree to indemnify and hold us harmless from claims arising from your violation of these Terms or misuse of the Website.
10. Termination
We may suspend or terminate your access at any time for any reason, including violation of these Terms.
11. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict of laws principles. Disputes shall be resolved in courts located in Catawba County, North Carolina.
12. Changes to Terms
We may update these Terms. Continued use constitutes acceptance of changes.
